What is the CASL?

Canada’s Anti-spam legislation is the federal law dealing with spam and other electronic threats. CASL is meant to protect Canadians while ensuring that businesses can continue to compete in the global marketplace. The CAN-SPAM Act is the American legislation, and relevant to your business if you have US citizens on your mailing list.

What defines “spam”?

To simply put it, “spam” is any communication that is unsolicited, unwanted. This means that buying email lists for your business’s monthly newsletter could be illegal spam.

This means that if you purchased a mailing list, those people did not give you expressed or implied consent, and therefore fall under spam regulation. You best way to avoid this? Ask for consent!

Ask for It.

Include a subscription box on every page of your website. Have the subscripe check box on your check out page. Create a call-to-action on social media to grab addresses (and confirm in that initial email that they want to be a part of it). To create a CASL compliant opt-in form, you need to include the following information:

  • What your recipients are opting into.
  • Your organizationโ€™s mailing address.
  • Your business phone number.
  • Your email address.
  • Your website URL.
Best Practices = Best Customers.

CASL is not the enemy. It benefits businesses by creating better B2C relationships, and therefore higher open rates, click-through rates, and longer lasting customers. Use CASL as a guide to your email best practices.
